CID Evidentiary and Investigative Resources Guide

The following is an updated list of evidentiary and investigative resources available to all Charlestown Police Department officers through the Criminal Investigations Division (CID).  These are resources which can assist officers in the “thorough investigation” process, when the Detective or an evidence technician is not directly involved in your case.  CLICK ON THE BELOW CATEGORIES FOR MORE.

Fusion Center Inquiry: CID can make a formal request of the Fusion Center (state law enforcement intelligence center) for BMV records (including a full-sized color photo), a National CLEAR report (which includes:  Suspect AKAs, Family Members with degree of separation) Associates by SSN, Addresses Associated with Suspect, Utility Service Links, Social Media links, vehicle registrations, Liens and Judgments, Marriages and Divorces, Bank and Business Affiliations, Aircraft and watercraft registrations, Foreclosures, Bankruptcies, and more).

Submit requests, via email to cledbetter@ctownpd.com, including the appropriate CASE #, CASE CLASSIFICATION, SUSPECT NAME, and SUSPECT DOB (at least). Add more suspect identifiers to increase the amount of information available.  Return is via emailed .pdf reports/files within 2-4 hours, unless URGENT is requested.

Leads On-Line Inquiry: CID can perform a transaction (records) search of nationwide pawn shops and metal recycling facilities, through an on-line service called Leads On-Line.  Search parameters include:  By Item, By Name/DOB, By Address, or By Item Description.  Not every pawn shop participates in the Leads On-Line network, but the majority are nationwide.  Leads On-Line also allows the CID to place a person or an item on an automatic search “Watch List”, whereas if pawn or buy activity matching the parameters occurs after an initial check, CID will be notified automatically via email.

Leads On-Line Inquiries are helpful when tracking stolen property, corroborating information, and identifying theft ring suspects. [/elitetoggle][/eliteaccordion] [eliteaccordion][elitetoggle title=”ATF FIREARM eTRACE INQUIRY”]

ATF Firearm eTrace Inquiry: Using the US ATF Database, CID can request documentation on tracking firearm dealer purchases and firearm movement. Specifically, tracing is a systematic process of tracking the movement of a firearm from its manufacture or from its introduction into U.S. commerce by the importer, through the distribution chain, i.e., wholesaler/retailer, to identify an unlicensed purchaser. That information can help to link a suspect to a firearm in a criminal investigation and identify potential traffickers. Firearms tracing can detect in-state, interstate and international patterns in the sources and types of crime guns.

Ensure all appropriate GUN, SUSPECT, and VEHICLE (if applicable) sections of the case are completed. Return is via emailed .pdf reports within 2-4 days, unless URGENT is requested.
ATF Firearm eTracing Reports should be requested on any gun confiscated or identified and used in a crime; or any time the history of the legal movement of a firearm is important.

MUGS PLUS Inquiry: CID can log into and perform a search of the Louisville (KY) Metro Corrections Arrest Book-in Database.  The database includes arrests and charges as well as addresses and color book-in photos, for suspects with possible Louisville-Jefferson County Kentucky (only) arrest activity.

Cell Phone Data: CID can assist with several forms of cell phone data, which if considered early enough in an investigation, can solve many criminal cases.  One resource which CID makes available to all officers, is the “Cell Phone Company Contact List” (a .pdf file located which the network CID Shared Folder under FORMS & GUIDES > CELL PHONE RESOURCES).  The Cell Phone Company Contact List is valuable for obtaining the procedures and Law Enforcement designated contact number for each Cell Service provider in the USA.

Number Identification- By using national computer databases, CID can check a 10-digit telephone number to determine if it is ported (registered to an bill payer) as well as what provider (AT&T, Verizon, etc.) services the number.

Historical Data- Acquired by Court Order (obtained through submission of a criminal case narrative to the prosecutor’s office), cellular historical data requests provide call, text, and usage reports that include date, time and location if specifically requested within a preserved period of time. Location refers to cell tower triangulation methods for which the cell phone in question is connected to during specific calls, and out-going texts.  Cell phone historical data can be used to confirm or disprove the statements of a suspect, victim or witness to a crime.  It is often important to request (in writing) that the cell phone service provider preserve the historical data to be requested, while execution of the court order is processed.

CID can assist with triangulation methods once requested data is received.

Exigent Circumstances GPS Locate (PING)- Official CHPD investigations, which involve a reasonable suspicion to believe that exigent circumstances exist:

1.) immediate danger of death or serious bodily injury to any person;

2.) conspiratorial activities characteristic of organized crime; or

3.) an immediate threat to a national security interest.

normally qualify for the pursuit of a Cell Phone GPS Locate (PING).  Once a cell phone number’s service provider has been identified and using the “Cell Phone Company Contact List”, a law enforcement officer can contact the provider’s emergency law enforcement number and request an affidavit be faxed to the CHPD for completion and signature to execute an exigent circumstances GPS cell phone locate.  The requesting law enforcement officer must be prepared to be challenged, according on the above criteria, that the situation is exigent; otherwise it is a illegal search issue.  GPS Locate approvals are normally active for a 48 hour period, allowing for multiple GPS ping attempts, according to the affidavit instructions.  GPS pings will not process if the subject cell phone is powered off.  The GPS coordinates provided on a successful PING are normally that of the nearest cell tower the subject cell phone is connected to at the time (normally a two mile radius area).

CID can assist with triangulation methods once requested data is received.

Real Time Trap, Trace or Wiretap-Official CHPD investigations, which involve an immediate threat of death or serious bodily injury to another person, coupled with probable cause of A Felony or Murder charges; normally justify the approval of a Real Time Cell Phone Trap and Trace (audio incept). This action requires a judge’s approval, much like a search warrant; as each cell service provider

Cell Phone Forensic Processing: CID can arrange and assist with the Forensic Processing of a cellular telephone which is suspected to contain evidence to support a criminal investigation of the CHPD.  The suspected cell phone should be collected and logged in as evidence (sealed clear plastic evidence bag) at the earliest possible opportunity, totally powered off and battery removed.  If possible*, confirm the service provider and 10-digit number of the phone before powering the phone off (* do not attempt this if the phone will first need to be processed for any type of exterior trace evidence).  A standard search warrant (device owner written Consent to Search) must be approved before any Forensic Processing can take place; of which CID can assist with acquiring if necessary.  Search warrants are preferred depending on the nature of the case and the age of the device owner/operator.

Cell Phone Forensic Processing involves creating a digital mirror copy of the device, preserving dates and times of most actions, including call logs and camera operations which have not been deleted.  The device copy is created in a forensic manner which makes it admissible evidence.

Cell Phone Forensic Processing is helpful when documenting changes made to a cell phone which might cover up probable cause of a crime and/or pornography activities/evidence (still images as well as videos).  [/elitetoggle][/eliteaccordion] [eliteaccordion][elitetoggle title=”INSPECT / eKASPER INQUIRY”]

INSPECT/eKASPER Inquiries: CID can perform a database (records) search of controlled substance prescriptions filled in INDIANA (Inspect) or KENTUCKY (eKasper).  Search parameters include:  By Name/DOB, By Address, or By Physician.

Inspect/eKasper inquiries are helpful when tracking prescription pill usage, corroborating information, and investigating prescription fraud.  [/elitetoggle][/eliteaccordion] [eliteaccordion][elitetoggle title=”FACEBOOK/INSTAGRAM/MY SPACE INQUIRY”]

Facebook/My Space Data Recovery: CID provides guides to assist officers with the legal preservation (securing records of content) and acquiring of Facebook and My Space content relating to an official criminal investigation.  These guides are available to all officers, in a .pdf file format, and located in the network CID Shared Folder under FORMS & GUIDES > INVESTIGATIVE RESOURCES).  It is often important to request (in writing) that the cell phone service provider preserve the historical data to be requested, while execution of the court order is processed.   At a minimum, a Court Order (obtained through submission of a criminal case narrative to the prosecutor’s office) is generally needed to obtain social networking media content.

Facebook/My Space Data Recovery becomes important to criminal investigation when confirming the veracity of information found on these social networking media sites, including confirming how and who posted the information.  [/elitetoggle][/eliteaccordion] [eliteaccordion][elitetoggle title=”ODYSSEY CASE MANAGEMENT INQUIRY”]

Odyssey Case Management System Log In: CID maintains an Odyssey Case Management System log in, which provides additional information about case data entered which is not available on the Public Access (no log in used) site views.  System log in privileges allows access to Defendant date of birth information as well as Court Calendars and fine amounts and payment status’.

Officers can submit a request, via email to cledbetter@ctownpd.com, to obtain full case view printouts of complete cases, according to CAUSE #.

Information provided generally assists officers in tracking the court progress of specific cases as well as locating identifiable information on defendants already with court history, whether it be a criminal court case or a civil/family court case.  [/elitetoggle][/eliteaccordion] [eliteaccordion][elitetoggle title=”ISP CRIME LAB DATABASE INQUIRY”]

ISP Crime Lab Database Inquiry: CID can access the Indiana State Police Lab Database for updates on the status of evidence submitted.  CID, for the convenience of officers, periodically provides completed lab reports (in .pdf file format) in the network CID Shared Folder under LAB REPORTS, according to the year of the case and case number the evidence was submitted to the lab under).  CID can assist by having database access to determine updated status.

Officers in search of a specific evidence ISP Lab Report, should first check the “LAB REPORTS” folder in the network CID Shared Folder. If the report is not found, according to case number, submit a request via email to cledbetter@ctownpd.com, including the appropriate CASE #, and EVIDENCE ITEM#.  This request is to acquire an update on the evidence submitted to the ISP Lab by CID.  Return is via emailed .pdf reports within 2-4 days, unless URGENT is requested.

ISP Crime Lab Database Inquiries become important when following up on a case where evidence was submitted to the ISP Lab for processing; or for trial preparation.   [/elitetoggle][/eliteaccordion] [eliteaccordion][elitetoggle title=”LENS NOTIFICATIONS”]

LENS Notifications:             CID automatically receives email notices, from the Indiana Department of Corrections, when Defendants incarcerated within their facilities, with Clark County addresses, are nearing scheduled release.  These email notices are forwarded to full time officer email addresses upon receipt, for purposes of general information and intelligence.

Officers requesting LENS notification via CHPD CID should submit a request via email to cledbetter@ctownpd.com, including the offender’s full name and DOB.  [/elitetoggle][/eliteaccordion]
