BY THE COMMON COUNCIL FOR THE CITY OF CHARLESTOWN, INDIANA
ORDINANCE NO. 1979-11
AN ORDINANCE REGULATING THE USE OF WEAPONS
WITHIN THE CITY LIMITS
WHEREAS, the Common Council is desirous of making the City of Charlestown a safe
place within which to live, and free from injury and/or property damage; and
WHEREAS, the members of the Common Council have received numerous complaints
from citizens regarding property damage resulting from BB guns and other weapons
being discharged within the city limits, and
WHEREAS, it is in the best interest of the public health, welfare, and safety to
do so,
NOW THEREFORE BE IT ORDAINED, by the Common Council for the City of Charlestown,
Indiana, as follows:
Section 1. It shall be unlawful to discharge any firearm, airgun, BB gun, or any
toy gun projecting lead or missiles excepting in a regularly established
gallery; provided that this section shall not be construed to prohibit any
officer of the law from discharging a firearm in the performance of his duty;
nor to any citizen from discharging a firearm when lawfully defending person or
property. Further, this ordinance shall not be construed to prohibit any citizen
from discharging an airgun, BB gun, or any toy gun projecting lead or missiles
upon their own private property so long as by such discharge, they are not
endangering the property or person of another.
Section 2. Any person, association of persons, or corporation violating the
provisions of this ordinance shall be fined not less than Five (5) dollars nor
more than Five Hundred (500) dollars.
